Terms of service

Purchases made on this website are governed by the standard terms of sale for consumer purchases of goods over the Internet set out below. Consumer purchases over the Internet are primarily regulated by the Norwegian Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act and the e-Commerce Act, and these acts grant consumers rights that cannot be waived. The acts are available at www.lovdata.no. The terms in this agreement are not to be understood as any limitation of the statutory rights, but set out the parties' key rights and obligations for the transaction.

These terms of sale have been prepared and are recommended by the Norwegian Consumer Authority (Forbrukertilsynet).

NOTE: These terms of sale apply only to consumers (B2C). Separate rules and terms apply to B2B purchases.

1. The Agreement

The agreement consists of these terms of sale, information provided in the order process and any separately agreed terms. In the event of any conflict between the information provided, what has been specifically agreed between the parties takes precedence, provided it does not conflict with mandatory legislation.

The agreement will further be supplemented by relevant statutory provisions governing the purchase of goods between traders and consumers.

2. The Parties

The Seller is House of Leonore AS, org. no. 937 254 539, Maridalsveien 87, 0461 Oslo, Norway, tel. +47 478 110 472, info@leonoreswim.no, referred to below as the Seller.

The Buyer is the consumer placing the order, referred to below as the Buyer.

3. Price

The stated price for the goods and services is the total price the Buyer must pay, including VAT (unless otherwise stated). This price includes all fees and additional costs. The Buyer shall not bear any further costs that the Seller has not disclosed prior to the purchase.

4. Conclusion of the Agreement

The agreement is binding on both parties once the Buyer has submitted the order to the Seller.

The agreement is nevertheless not binding if there has been a clerical or typing error in the Seller's offer in the online store's order process, or in the Buyer's order, and the other party realized or should have realized that such an error existed.

5. Payment

The Seller may require payment for the goods from the time the goods are dispatched from the Seller to the Buyer. Payment methods vary by market: in Norway, credit/debit card, Vipps and Klarna; in Sweden, credit/debit card, Swish and Klarna; in Denmark, credit/debit card, MobilePay and Klarna; and in other European markets, credit/debit card and Klarna. Invoice may be available where offered at checkout.

If the Buyer pays by credit card or debit card, the Seller may reserve the purchase amount on the card at the time of order. The card is charged on the same day the goods are shipped. Card payments are processed through the available payment provider.

Where invoice payment is available, the invoice to the Buyer is issued when the goods are dispatched. The payment deadline is stated on the invoice and is a minimum of 10 days from receipt.

Buyers under the age of 18 cannot pay by invoice.

6. Delivery

Delivery has taken place once the Buyer, or the Buyer's representative, has taken possession of the goods.

If the delivery time is not stated in the order process, the Seller shall deliver the goods to the Buyer without undue delay and no later than 30 days after the order is placed. The goods shall be delivered to the Buyer unless otherwise specifically agreed between the parties.

Standard order processing time is the same day or the next day, and shipping time typically takes 2 to 7 business days.

7. Risk for the Goods

Risk for the goods passes to the Buyer once the Buyer, or the Buyer's representative, has received the goods in accordance with Section 6.

8. Right of Withdrawal

Unless the agreement is exempt from the right of withdrawal, the Buyer may cancel the purchase of the goods in accordance with the Right of Withdrawal Act. Separate rules apply to business purchases.

The Buyer must notify the Seller of the use of the right of withdrawal within 14 days from the date the deadline starts to run. All calendar days are included in the deadline. If the deadline ends on a Saturday, public holiday or holy day, the deadline is extended to the next working day.

The withdrawal deadline is deemed met if notice is sent before the deadline expires. The Buyer bears the burden of proof that the right of withdrawal has been exercised, and notice should therefore be given in writing (withdrawal form, email or letter).

For the purchase of individual goods, the withdrawal deadline starts running from the day after the goods are received. Where a subscription is sold, or the agreement involves the regular delivery of identical goods, the deadline runs from the day after the first shipment is received. Where the purchase consists of multiple deliveries, the withdrawal deadline runs from the day after the last delivery is received.

The withdrawal deadline is extended to 12 months after the expiry of the original deadline if the Seller does not, prior to conclusion of the agreement, provide information on the right of withdrawal and the standardized withdrawal form. The same applies where information on the terms, deadlines and procedure for exercising the right of withdrawal is not provided. If the trader provides this information within those 12 months, the withdrawal deadline nevertheless expires 14 days after the day the Buyer received the information.

Exception for hygiene products

Norway (excluding Svalbard and Jan Mayen)

In accordance with Section 22 of the Right of Withdrawal Act, the right of withdrawal does not apply to sealed hygiene products. Bikini bottoms are classified as hygiene products and cannot be returned or exchanged.

Bikini tops, like bikini bottoms, are classified as hygiene products under Section 22 of the Right of Withdrawal Act and cannot be returned or exchanged, regardless of whether the seal has been broken.

European Union

For hygiene reasons, bikini bottoms and underwear cannot be returned if the hygiene seal or protective strip has been removed, broken, or otherwise tampered with.

This is in accordance with Article 16(e) of EU Directive 2011/83/EU on consumer rights, which provides an exception to the right of withdrawal for sealed goods that are not suitable for return due to health protection or hygiene reasons once the seal has been broken.

If the hygiene seal or protective strip remains fully intact, the standard 14-day right of withdrawal applies.

This does not affect your statutory rights if the product is faulty or defective.

We recommend checking the size guide carefully before ordering. If you are unsure about sizing, please contact customer service before placing your order.

Requirements for returned goods

For a return to be approved, the goods must generally be unused, in their original packaging, with all tags intact and in the same condition as when received.

Returns of hygiene products where the hygiene seal or protective strip has been removed, broken, or tampered with will not be approved.

How to exercise the right of withdrawal

Returns can only be requested via My Page. The Buyer can log in to My Page at konto.leonoreswim.no, find the relevant order and click "Request return".

Once the return is approved, a return label is sent automatically by SMS and/or email. Take the package to your nearest UPS location. They can help you print the label if needed. Attach the label to the package before drop-off.

All returns are sent to: Arnes vei 8, 0488 Oslo, Norway.

Return costs

The Buyer bears the direct costs of returning the goods. For deliveries within Norway (excluding Svalbard and Jan Mayen), return shipping is a flat fee of NOK 95, including VAT, deducted automatically from the total refund amount. For deliveries to other countries, the Buyer is responsible for covering the actual cost of return shipping. The Seller cannot charge the Buyer any fee for exercising the right of withdrawal beyond this.

Refund

When exercising the right of withdrawal, the goods must be returned to the Seller without undue delay and no later than 14 days from the date notice of withdrawal is given. The Seller is obliged to refund the purchase price without undue delay, and no later than 14 days from the date the Seller received notice of the Buyer's decision. The Seller has the right to withhold payment until the goods have been received, or until the Buyer has provided documentation that the goods have been sent back. Approved returns are refunded to the same payment method used for the purchase.

Exchange for a different size

The Seller does not offer direct exchange of goods. A Buyer who wants a different size must exercise the right of withdrawal and request a return via My Page at konto.leonoreswim.no. Once the return has been received and approved, the purchase price, including the original shipping cost, is refunded. For Buyers in Norway, NOK 95 in return shipping is deducted from the refund. For Buyers in other countries, the Buyer covers the actual return shipping cost, which is not refunded. The Buyer can then place a new order in the online store for the desired size at the standard price and shipping terms. Please note that hygiene products are subject to the restrictions set out in the section on hygiene products above, and cannot be returned or exchanged where those restrictions apply.

9. Delay and Non-Delivery: The Buyer's Rights and Deadline for Making a Claim

If the Seller does not deliver the goods, or delivers them late under the agreement between the parties, and this is not due to the Buyer or circumstances on the Buyer's side, the Buyer may, depending on the circumstances and in accordance with Chapter 5 of the Consumer Purchases Act, withhold the purchase price, demand performance, cancel the agreement and/or claim damages from the Seller.

For evidentiary purposes, any claim based on breach of contract should be made in writing (for example, by email).

The Buyer may uphold the purchase and demand performance from the Seller. However, the Buyer cannot demand performance if there is an impediment the Seller cannot overcome, or if performance would impose such a disproportionate burden or cost on the Seller that it is significantly out of proportion to the Buyer's interest in the Seller performing. Should these difficulties be resolved within a reasonable time, the Buyer may still demand performance. The Buyer loses the right to demand performance if the Buyer waits an unreasonably long time before making the claim.

If the Seller does not deliver the goods at the agreed time, the Buyer shall request that the Seller deliver within a reasonable additional deadline for performance. If the Seller does not deliver the goods within this additional deadline, the Buyer may cancel the purchase. The Buyer may, however, cancel the purchase immediately if the Seller refuses to deliver the goods. The same applies if delivery at the agreed time was decisive for entering into the agreement, or if the Buyer has notified the Seller that the delivery time is decisive.

The Buyer may claim compensation for losses suffered as a result of the delay, unless the Seller demonstrates that the delay is due to an impediment beyond the Seller's control that could not reasonably have been taken into account at the time the agreement was entered into, avoided, or the consequences of which could not reasonably have been overcome.

10. Defects in the Goods: The Buyer's Rights and Deadline for Complaints

If there is a defect in the goods, the Buyer must, within a reasonable time after discovering it or after it should have been discovered, notify the Seller that the Buyer intends to invoke the defect. The Buyer has always complained in time if this occurs within 2 months from when the defect was discovered or should have been discovered. A complaint may be made no later than two years after the Buyer took delivery of the goods. If the goods, or parts of them, are intended to last significantly longer than two years, the complaint deadline is five years.

If the goods have a defect and this is not due to the Buyer or circumstances on the Buyer's side, the Buyer may, depending on the circumstances and in accordance with Chapter 6 of the Consumer Purchases Act, withhold the purchase price, choose between repair and replacement, demand a price reduction, demand cancellation of the agreement and/or claim damages from the Seller. Complaints to the Seller should be made in writing.

The Buyer may choose between demanding that the defect be remedied or delivery of an equivalent item. The Seller may nevertheless refuse the Buyer's demand if fulfilling it is impossible or would impose unreasonable costs on the Seller. Repair or replacement shall take place within a reasonable time. In principle, the Seller does not have the right to make more than two attempts to remedy the same defect.

The Buyer may demand an appropriate price reduction if the goods are not repaired or replaced. If the goods are not repaired or replaced, the Buyer may also cancel the purchase where the defect is not immaterial.

11. The Seller's Rights in the Event of the Buyer's Breach

If the Buyer does not pay, or does not fulfill the other obligations under the agreement or the law, and this is not due to the Seller or circumstances on the Seller's side, the Seller may, depending on the circumstances and in accordance with Chapter 9 of the Consumer Purchases Act, withhold the goods, demand performance of the agreement, demand cancellation of the agreement and claim damages from the Buyer. Depending on the circumstances, the Seller may also claim interest on late payment, debt collection fees and a reasonable fee for uncollected goods.

The Seller may uphold the purchase and demand that the Buyer pay the purchase price. If the goods have not been delivered, the Seller loses this right if it waits an unreasonably long time before making the claim.

The Seller may cancel the agreement in the event of material payment default or other material breach on the part of the Buyer. However, the Seller cannot cancel if the full purchase price has been paid. If the Seller sets a reasonable additional deadline for performance and the Buyer does not pay within this deadline, the Seller may cancel the purchase.

If the Buyer does not pay the purchase price in accordance with the agreement, the Seller may charge interest on the purchase price under the Norwegian Act on Interest on Overdue Payments. In the event of non-payment, the claim may, after prior notice, be sent to debt collection. The Buyer may then be held liable for fees under the Debt Collection Act.

If the Buyer fails to collect unpaid goods, the Seller may charge the Buyer a fee. The fee shall cover, at most, the Seller's actual costs of delivering the goods to the Buyer. Such a fee cannot be charged to buyers under the age of 18.

12. Warranty

A warranty given by the Seller or the manufacturer gives the Buyer rights in addition to those the Buyer already has under mandatory legislation. A warranty therefore does not entail any limitation of the Buyer's right to complain and make claims in the event of delay or defects under Sections 9 and 10.

13. Personal Data

The Seller is the data controller for the personal data collected. Unless the Buyer consents otherwise, the Seller may, in accordance with the Personal Data Act, only collect and store the personal data necessary for the Seller to fulfill its obligations under the agreement. The Buyer's personal data will only be disclosed to others if necessary for the Seller to fulfill the agreement with the Buyer, or in cases required by law.

Read more in our Privacy Policy.

14. Dispute Resolution

Complaints should be directed to the Seller within a reasonable time, cf. Sections 9 and 10. The parties shall attempt to resolve any disputes amicably. If this is not successful, the Buyer may contact the Norwegian Consumer Council (Forbrukerrådet) for mediation. The Consumer Council can be reached by telephone on +47 23 400 500 or at www.forbrukerradet.no.

The European Commission's complaints portal can also be used if you wish to file a complaint. This is particularly relevant if you are a consumer residing in another EU country. The complaint can be filed here: http://ec.europa.eu/odr.
